“Tailoring Rule” invalid
On June 23, the Supreme Court ruled against the EPA plans to require permits for sources of greenhouse gas emissions.
The “Tailoring Rule” that would have allowed EPA to regulate a large number of facilities was ruled invalid. However, while the ruling does not allow for regulation due to greenhouse gas emissions levels, facilities can and will continue to be regulated under PSD permits.
