MD Composting Facility Regs Effective 01-JUL-2015

The Maryland Department of the Environment (MDE) adopted new regulations, COMAR 26.04.11 – Composting Facilities, which establish a regulatory structure and requirements for composting facilities. The new structure includes composting facility “tiers” based on “feedstock types and sizes; different types of composting facility permits, along with permit exemptions; siting, design, and operational requirements for facilities; processes for the approval of variances, pilot programs, and research activities; procedures for enforcement; timeframe and procedure for existing composting facilities to come into compliance with the requirements; and recordkeeping and reporting requirements.”

“. . . . C. Tier 3 composting facilities are subject to the requirements in:
(1) COMAR 26.04.06, for facilities composting sewage sludge;

. . . . (37) “Tier 3 Facility” means a facility that accepts any Type 3
feedstocks, regardless of whether other feedstock Types are also
accepted.

. . . . “Type 3 feedstock” means:
(a) Sewage sludge, as defined in COMAR 26.04.06.03;
(b) Biosolids, as defined in COMAR 26.04.06.03;”
